A judge ruled today that an 85-year sentence for a man convicted of raping a 92-year-old Leawood woman would not be unconstitutional. Judge Stephen Tatum made the ruling today, according to the Star.

Simon

Angilda was convicted

in January of raping the elderly woman while drunk and high

on Ecstasy last June. Angilda’s

defense attorney had argued that 85 years amounted to cruel and unusual

punishment.

Prosecutors weren’t feeling much sympathy for Angilda, who violated a

protection order and called

the woman from prison after his arrest.
