Teen charged in shooting at 4200 Park

David L. Smith told police that he accidentally shot 15-year-old D’Shawn Clayton Tuesday night, court documents say.
Smith allegedly called 911 around 9:36 p.m. Tuesday and said he didn’t know the gun was loaded and shot his friend.
Court records say witnesses told police that Smith, Clayton and
others were in a home at 4208 Park smoking marijuana and talking. Smith
was showing off his gun and pointed it at Clayton and the gun went off.
Everyone ran from the house. But one witness went back to the basement
to get the gun and asked Smith what to do with it. “I don’t want any
part of it anymore,” Smith allegedly said. The witness said he hid the
gun behind a house up the street.
The records also say medical
personnel didn’t expect Clayton to survive. Around 2 a.m. Wednesday,
Clayton was on life support in the intensive care unit of a local
hospital.
Smith told detectives that he’d let Clayton hold the gun and then
removed the clip from it. Later, he picked the gun up, pointed it at
Clayton and pulled the trigger not realizing that the clip was back in
it or that the gun had a live round ready to be fired.
Jackson County prosecutors charged Smith with second-degree assault and armed criminal action.
